Terms of Service

Secret Santa Generator draws names for a gift exchange. The organizer types the names and a few details, the draw runs on our server, and every participant gets a private link that shows only their own match, the budget, the date and their match's wishlist. Drawing names for 3 to 200 people and the features around it (exclusions, last year's pairs, wishlists, changes after the draw, printed slips and printable cards) are free. The optional Event Pass adds anonymous messages for one event; the organizer, or anyone in the group from their own private link, can turn it on.

In an event with an Event Pass, each participant can send messages of up to 500 characters to the person they drew and to their own Secret Santa. We show a message only on the pages of the two people it is between, without saying who wrote it; the organizer page never shows messages. Anyone holding a private link can read the messages on it, so keep links private. Messages are deleted with the event.

Use the site to organize gift exchanges for groups you belong to or run. You must not:

• use messages to harass, threaten, shame or frighten anyone, or to send sexual content, hate speech or spam;
• use messages to share anything illegal, or other people's private information without their permission;
• try to find out who drew whom by breaking or overloading the site, or use it to collect other people's data;
• buy an Event Pass with a payment method you aren't allowed to use.

You must not use the site to create or share content that infringes anyone else's intellectual property, such as their songs, lyrics, music, images, characters or trademarks, or to pass content off as made or endorsed by a real artist, creator or brand. If you do, we remove the content, may block your access, and handle any payment under our refund policy.

You must not use the service for sexual content, violent or gory content (graphic injury, cruelty or extreme violence), or hate speech (hateful, discriminatory, demeaning or inciting content aimed at people because of race, ethnicity, religion, sex, sexual orientation, disability or similar traits).

Child sexual abuse material (CSAM) - zero tolerance: you must never upload, request, create or share any sexual or sexualised depiction of a minor, or any content that sexualises, exploits or endangers a child. We remove it immediately, permanently block the account, preserve the necessary records and report it to the National Center for Missing & Exploited Children (NCMEC) and the relevant authorities.

Non-consensual intimate imagery (NCII): you must never upload, create or share nude, sexual or intimate images, audio or video of a real person without their consent, including private intimate material, "undressing" or nudifying a person, or placing someone into an intimate scene. We remove it as soon as we learn of it, block the account, and support the person depicted, including takedown requests and cooperation with law enforcement.

If you receive a message that breaks these rules, email hello@secretsantagenerator.xyz with the link to your page (or the event name) and the text of the message. We confirm that we have your report and act on it within 2 business days: we can delete the message, switch off messages for that event, and block the sender's link. Repeated or serious abuse can lead to the whole event being deleted and the Event Pass being cancelled without a refund. If you think a decision was wrong, reply to our email and we will look at it again.

• Drawing names, private links, exclusions, wishlists, changes after the draw and printed slips are free, with no account and no email address needed.
• The Event Pass costs $4.99 per event and is a one-time payment. There is no subscription and nothing renews.
• Payments are processed by our merchant of record, Waffo Pancake (waffo.ai), which takes the payment, works out any sales tax or VAT and issues your receipt. Its own terms and privacy policy apply to the payment.

There is nothing to cancel: the draw is free and the Event Pass is a single payment that never renews. An Event Pass code you haven't used on any event can be refunded within 14 days of buying it. A pass that has been turned on for an event is not refundable, except where the law requires otherwise. Our refund policy has the details and explains how to ask.

You keep all rights to what you type: names, notes, wishlists and messages. You give us permission to store and show it to the people it is meant for, only to run the service. Event data, including messages, is deleted automatically after the exchange, as described in our privacy policy, and the organizer can delete an event at any time.

The site is provided as it is and as available. As far as the law allows, we make no promises, express or implied, that it will always be available, free of errors or fit for a particular purpose. We aren't responsible for the gifts people choose, buy or send.

As far as the law allows, we are not liable for indirect or consequential losses. Our total liability to you for anything to do with the site is limited to what you paid us in the 12 months before the claim, or USD 10 if you haven't paid anything. Nothing in these terms limits liability that can't be limited by law.

We may update these terms of service. The date at the top shows the current version. If a change matters, for example to prices or to what we keep, we'll point it out on this page. If you keep using the site after a change, the new terms apply.
